Ex-St. Louis Cop Acquitted in 2011 Shooting of Black Driver

Stockley waived his right to a jury trial.

On Friday, the judge took the side of the former officer who resigned in 2013.

Stockley shot Smith following a police chase on December 20, 2011.

"This Court, in conscience, can not say that the state has proven every element of murder beyond a reasonable doubt, or that the state has proven beyond a reasonable doubt that the defendant did not act in self-defense", Wilson wrote in the ruling, which was published by The St. Louis Post-Dispatch. However, he claims that he didn't recall saying it. Wilson wrote the statement "was not intelligible" and that its "context is not clear". Stockley's DNA was found on the gun, according to court documents, and Smith's was not. Stockley said over the police radio that Smith, fired a gun.

The St Louis Metropolitan Police Department initially deemed the killing justifiable. Prosecutors claimed Stockley planted a gun in Smith's auto. The bus moved less than a block before police in riot gear began pushing back the crowd.

Forensic analysis revealed that Stockley's was the only DNA present on the gun he said belonged to Smith, the criminal complaint said.

Updated at 3 p.m. with announcement that all branches of St. Louis Library closing early. It's a violation of St. Louis police policy to carry a personal weapon.

Stockley also defended entering Smith's vehicle to retrieve the firearm he believed was in there.

Overcoming the burden of self-defense of a police officer is a challenging task. She also said she is aware there is a lot of anxiety and worry in the community but that people should not let that determine how they treat one another. Activists have threatened protests and civil disobedience if Stockley was acquitted and protesters have been organizing across from City Hall since the verdict was announced Friday morning shortly after 9 a.m. Demonstrators have shut down the downtown on-ramp to Highway 64. Bruntrager said he was justified to use lethal force before the chase when the suspect's auto was a deadly weapon.
